These Terms and Conditions govern your use of services provided by Andes & Alps, operated by Alex McInnes ("we", "us", or "our"). By booking a Shotgun Audit or engaging our services, you agree to these terms.

1. Services

Andes & Alps provides marketing consultancy services, including but not limited to the Shotgun Audit — a free 45-minute consultation call. The audit is provided at no charge and is intended to offer honest, independent marketing insights.

2. The Shotgun Audit

The Shotgun Audit is a free service. It does not constitute a binding proposal, contract, or guarantee of outcomes. Insights provided during the call are advisory in nature. Any follow-on engagement is subject to a separate agreement.

We reserve the right to decline or reschedule bookings at our discretion.

3. Paid Engagements

Any paid services agreed following the audit will be governed by a separate written agreement or proposal, which will detail scope, fees, timelines, and payment terms. No work will commence on paid projects without written agreement from both parties.

4. Intellectual Property

All strategies, frameworks, documents, and materials created by Andes & Alps remain our intellectual property until full payment has been received, at which point agreed deliverables transfer to the client.

You grant us permission to reference your business as a client for case study or portfolio purposes, with your explicit consent.

5. Confidentiality

We treat all information shared during consultations as confidential and will not disclose it to third parties without your permission, except where required by law.

6. Session Recording

Shotgun Audit calls may be recorded for internal note-taking purposes. Recordings will not be shared or published without your explicit written consent.

7. Limitation of Liability

Our advice is provided in good faith based on the information available to us. We cannot guarantee specific business outcomes. To the maximum extent permitted by law, Andes & Alps is not liable for any indirect, consequential, or loss of revenue arising from acting on our recommendations.

8. Governing Law

These terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes will be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.

9. Changes to These Terms

We may update these terms from time to time. Continued use of our services after any changes constitutes acceptance of the updated terms.
